Regulation (EU) 2018/1807 (FFD Regulation) — on a framework for the free flow of non-personal data in the European Union of 14 November 2018 entered into force since December 2018 and applied since 28 May 2019. The aim of the Regulation is to achieve a more competitive and integrated EU market for data storage and processing services and activities.
The Regulation:
- removes unjustified or disproportionate national rules that hamper or restrict companies in choosing a location for storage or processing of their data. Member States will have to notify the Commission of new or existing data localisation requirements.
- set up a cooperation mechanism to ensure that competent authorities have access to data processed in another Member State.
- encourage the development of self-regulatory codes of conduct to facilitate the switching of providers and data transfer.
